I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to all contracts concluded with us as the seller (Dario Bernhard) via the website Peacemaker24-7.com, unless otherwise expressly agreed. The inclusion of any of your own terms and conditions is hereby rejected unless otherwise agreed upon.
(2) A consumer in the sense of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is any natural or legal person or a partnership with legal capacity who acts in the course of their independent professional or commercial activity when concluding a legal transaction.
§ 2 Conclusion of the Contract
(1) The subject matter of the contract is the sale of goods.
Our product listings on the internet are non-binding and do not constitute a binding offer to conclude a contract.
(2) You can submit a binding purchase offer (order) via our online shopping cart system. The goods intended for purchase are placed in the “shopping cart.” Using the appropriate button in the navigation bar, you can access the “shopping cart” and make changes at any time. After proceeding to the checkout by clicking the appropriate button ("Checkout" or "Proceed to Purchase" or similar), entering your personal data as well as payment and shipping information, a final overview of your order will be displayed.
Before submitting the order, you have the opportunity to review and change the details (also via the “back” function of your internet browser) or to cancel the order altogether.
By submitting the order via the corresponding button ("Order with obligation to pay," "Buy," "Purchase now" or similar), you make a binding offer to us.
You will then receive an automatic email acknowledging receipt of your order, which does not yet constitute acceptance of your offer.
(3) Acceptance of your offer (and thus the conclusion of the contract) occurs within 2 days by confirmation in text form (e.g., email), explicitly confirming either the execution of the order or the dispatch of the goods (order confirmation). If you do not receive such confirmation within this period, you are no longer bound by your order. Any payments already made will be refunded immediately.
(4) Order processing and transmission of all necessary information relating to the contract are carried out by email, partly automated. You must therefore ensure that the email address you have provided to us is correct, that you are technically able to receive emails, and that these are not blocked by spam filters.
§ 3 Right of Retention, Retention of Title
(1) You may exercise a right of retention only insofar as it relates to claims arising from the same contractual relationship.
(2) The goods remain our property until full payment of the purchase price has been made.
§ 4 Warranty
(1) Statutory warranty rights apply.
(2) As a consumer, you are kindly requested to check the goods immediately upon delivery for completeness, obvious defects, and transport damage, and to notify us and the carrier of any complaints as soon as possible. Failure to do so will not affect your statutory warranty rights.
(3) If a feature of the goods deviates from the objective requirements, this deviation shall be deemed agreed upon only if you were informed of the deviation prior to submitting the contractual declaration and the deviation was expressly and separately agreed upon between the parties to the contract.
§ 5 Choice of Law
(1) The law of the Federal Republic of Germany shall apply. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn (principle of favorability).
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
